Data protection
- Responsible for data processing and data protection officer
Feelgood Shop attaches great importance to the protection of privacy and the protection of customers' personal data. This Privacy Statement applies to www.feelgood-shop.com (the "Website") and your personal data processed by Feelgood Shop B.V., Celsiusweg 25A, 5928 PR in Venlo, the Netherlands, as data controller.
You can contact our data protection officer at any time via info@feelgood-shop.com
- What information do we process and store about you?
We process personal data about you from various sources, including personal data (a) that you have provided yourself and (b) that we obtain through your visit to the website.
-
a) Personal data that we receive directly from you as a customer
We may collect your personal data directly when you provide us with this data for registration, to purchase a product, to ask a question in writing or by telephone on our telephone hotline, to participate in competitions, to receive information or e-mails or for other reasons. We assure you that we only collect this personal data if you provide it yourself and voluntarily. We may collect the following personal data from you:
- Name
- your address
- e-mail address
- user name
- Landline or cell phone number for telephone orders
- Customer number
- payment information
- Passwords (We only hold encrypted passwords to see if the rights holder logs in. We do not have access to the passwords and/or knowledge of passwords).
- Orders and memos
- Payment history
- Registration for our newsletter
The data collected by us does not fall under special categories of personal data, as the purchase of our products does not allow any direct conclusions to be drawn about, for example, an illness of the purchaser and, in particular, does not involve health data.We have come to this decision because food supplements are merely foodstuffs which, by legal definition, cannot have a curative effect and are therefore not used to treat illnesses. They merely help to normalize deficiencies of certain nutrients. In summary, the purchase of a special dietary supplement says nothing about a possible illness of the purchaser.
-

- Transfer of your personal data to third parties
The personal data we collect is generally processed within our company. In addition, we may also transfer personal data to third parties outside our company to the extent permitted by law, in particular to
- those recipients to whom we must transfer personal data in order to fulfill concluded contracts (e.g. to delivery and logistics companies that deliver the items you have ordered from us to your home or payment service providers)
- the service providers engaged by us who provide services for us on a separate contractual basis, which may also include the processing of personal data, as well as the subcontractors of our service providers engaged with our consent;
- third parties engaged by us only with your consent to help us process and analyze personal data to improve our products and services and to monitor the effectiveness of a particular advertisement or campaign and to show you interest-based advertising on our website and third party websites (for more information, please refer to our Cookie Notice and your cookie settings); and
- non-public and public bodies, insofar as we are obliged to transfer your personal data due to legal obligations.
In principle, we process personal data exclusively within the EU or the European Economic Area. In individual cases, however, it may be necessary for us to transfer information to recipients in so-called "third countries". "Third countries" are countries outside the European Union or the Agreement on the European Economic Area in which a level of data protection comparable to that in the European Union cannot be assumed without further ado. If the transferred information also includes personal data, we ensure before such a transfer that the required adequate level of data protection is guaranteed in the respective third country or at the recipient in the third country. This may result in particular from a so-called "adequacy decision" of the European Commission, which establishes an adequate level of data protection for a specific third country as a whole. Alternatively, we can also base the data transfer on the so-called EU standard contractual clauses agreed with a recipient or on a declaration of consent given by you accordingly.
We will be happy to provide you with further information on the suitable and appropriate guarantees for compliance with an appropriate level of data protection on request. Further information on the so-called EU standard contractual clauses can be found at https://ec.europa.eu/info/law/law-topic/data-protection/international-dimension-data-protection/standard-contractual-clauses-scc_en and information on the adequacy decisions can be found at https://ec.europa.eu/info/law/law-topic/data-protection/international-dimension-data-protection/adequacy-decisions_en.
- No use of automated decision-making
In connection with the processing of your personal data described in this data protection information, we generally do not use automated decision-making (including profiling) within the meaning of Art. 22 GDPR. If we were to use such procedures in individual cases, we would of course inform you of this separately.
- How long we store your personal data
In principle, we store your personal data as long as this is necessary for the respective processing purpose or we have a legitimate interest in this storage and your interests in not continuing the storage or processing do not outweigh this. This means that we only store your data for as long as is necessary to provide our website and the associated services or as long as we are legally obliged to store this data. We also delete personal data without the intervention of the person concerned as soon as it is no longer required for the purpose of processing or storage is otherwise not permitted by law. The personal data that we must store in order to fulfill retention obligations will be stored until the end of the respective retention obligation. Insofar as we store personal data exclusively for the fulfillment of retention obligations, the processing in this regard is generally restricted so that it can only be accessed if this is necessary with regard to the purpose of the retention obligation.
As a rule, we delete your personal data if you have not contacted us for two years (order, telephone call, click on e-mail newsletter, etc.). We store the data for this long period to make it easier for you to enter the data when you place another order or contact us in another way. Please refer to our cookie notice or the cookie settings for the storage period.
- Protection of your personal data
We have taken appropriate administrative, technical and physical measures to protect the personal data you provide from accidental, unlawful or unauthorized destruction, loss, alteration, review, disclosure or use and other unlawful forms of processing.
The Website may contain hyperlinks to other third party websites. We have no control over these third party websites or the content of these websites. Once you leave our website, we are not responsible for the protection and privacy of any information which you provide to us. Be careful and check the privacy policy of third party websites.
- Changes to our privacy policy
We may amend this Privacy Policy from time to time by posting an update to this version here. To stay up to date, we recommend that you visit these pages regularly.
- Your rights and contacting Feelgood Shop
As a data subject affected by data processing, you have various rights, which we would like to inform you about in more detail below. You can also find details on this directly in Articles 15 to 21 of the GDPR.
To exercise these rights, you are welcome to contact us or our data protection officer, whose contact details are given above, or conveniently use the technical means provided by us (e.g. the cookie settings for managing or revoking consent given in this way).
- Right to information
You have the right to obtain information from us as to whether and what data we process about you. This includes, among other things, information on how long and for what purpose we process the data, where it comes from and to which recipients or categories of recipients we pass it on. We can also provide you with a copy of this data.
- Right to rectification
As a data subject, you have the right to obtain from us without undue delay the rectification of inaccurate or no longer accurate personal data concerning you. You can also request that we complete your incomplete personal data. If this is required by law, we will also inform third parties about this correction if we have passed on your data to them.
- Right to erasure (so-called "right to be forgotten")
You have the right to obtain from us the erasure of your personal data without undue delay where one of the following grounds applies
- your data is no longer necessary for the purposes for which it was collected or otherwise processed, or the purpose has been achieved;
- you withdraw your consent and there is no other legal basis for the processing
- you object to the processing and there are no overriding legitimate grounds for the processing; where personal data is used for direct marketing purposes, a simple objection to the processing by you is sufficient
- your personal data has been processed unlawfully;
- the deletion of your personal data is necessary to fulfill a legal obligation under Union law or the law of the Member States to which we are subject.
- Right to restriction of processing (blocking)
You also have the right to request that we restrict the processing of your personal data if one of the following conditions is met
- you contest the accuracy of your personal data, for a period enabling us to verify the accuracy of the personal data;
- the processing is unlawful and you oppose the erasure of the personal data and request the restriction of their use instead
- we no longer need your personal data for the purposes of the processing, but you require them for the establishment, exercise or defense of legal claims, or
- you have objected to processing pending the verification whether our legitimate grounds override yours.
If you have obtained a restriction of processing in accordance with the above list, we will inform you before the restriction is lifted.
- Right to withdraw consent
You can revoke any consent you have given us at any time with effect for the future. This revocation can be made in the form of an informal message to the above-mentioned contact addresses or via the technical means provided by us for this purpose (cookie settings). If you withdraw your consent, this will not affect the lawfulness of the data processing carried out up to that point.
- Right to data portability
As a data subject, you have the right to receive the personal data concerning you, which you have provided to us, in a structured, commonly used and machine-readable format and to transmit those data to another controller. Details and restrictions can be found in Art. 20 GDPR. The exercise of this right does not affect your right to erasure.
- Right to lodge a complaint with the supervisory authority
If you believe that the processing of your data by us violates applicable data protection law, you have the right to lodge a complaint with a supervisory authority.
- Right to object
As a data subject, you have the right to object, on grounds relating to your particular situation, at any time to processing of personal data concerning you which is based on point (e) or (f) of Article 6(1) GDPR, including profiling based on those provisions. In the event of such an objection, we will no longer process the personal data concerning you unless we can demonstrate compelling legitimate grounds for the processing which override your interests, rights and freedoms as the data subject or for the establishment, exercise or defense of legal claims.
Where we process personal data for direct marketing purposes, you have the right to object at any time to processing of personal data concerning you for such marketing, which includes profiling to the extent that it is related to such direct marketing.
If you, as the data subject, object to processing for direct marketing purposes, we will no longer process the personal data concerned for these purposes.
